What is Breakout Point?

Breakout Point GmbH is a company located in Germany. At Breakout Point:

What is an activist short seller?

A short seller is a market participant that seeks and finds a stock that occurs to be ready for a decline, puts a bet on decline by short selling the stock, and profits if the stock declines. A short seller borrows stock's shares, sells them ("goes short"), and attempts to cover the short position by buying shares back at the lower price.

Activist short sellers are short sellers that publicly present and discuss own short ideas. Compared to many other market participants, activist short sellers are more vocal and less secretive about their short investment ideas. Thus, sometimes we call them: investors with a megaphone.

What data I need when subscribing to your plans?

You need a valid email address and a valid credit card - and that's it. Our payment gateway, Stripe handles the payment processing for us, so your credit card details are not kept on our servers. We value your privacy and our goal is to keep a minimum of your data that still enables us to offer and improve our services.

How can I pay for your subscriptions?

Stripe handles the payment processing for us. You can use all major credit cards. All our subscription billing is auto-renewing, which means you will continue to get billed monthly until you cancel your subscription. You can learn more about Stripe by visiting their website here.

Can I cancel anytime? How? Is there a cancellation fee?

You can cancel your subscription at anytime. Your cancellation is effective at the end of a calendar month (i.e. at the end of the billing cycle) and is not retroactive. You will still have access to your service until the cancellation becomes effective. If you want to stop recurring payments you need to cancel the corresponding subscription on the Manage Account page under My Account section.There's no cancellation fee.

How am I billed? What is pro-rata billing?

Our billing cycle starts on the first day of each calendar month and ends on its last. To ensure that you are charged accurately and fairly for the services you use we employ proration for the first subscription month. Thus, in the first month the fee will be calculated on a pro-rata basis, depending on the days remaining in such calendar month. Proration for the first subscription month is applied both to: your very first subscription when you join Breakout Point, and, any upgrade, downgrade or addition to existing subscriptions if you are already a user. Proration value is calculated by our payment gateway, Stripe and will appear on your first next invoice.

Here are two examples, assuming that a billing cycle lasts 30 days:

  • Example 1: If you join Plan X after 15 days of the month, you will be charged Plan X prices for one-half of the month in the first subscription month.
  • Example 2: If you use Plan Y for 10 days and upgrade or downgrade to Plan Z for remaining 20 days, you will be charged, for that month, Plan Y prices for one-third of the month and Plan Z prices for remaining two-thirds.

Do you offer custom solutions?

In addition to our standard and premium monthly plans, we offer custom solutions that we tailor towards your needs. Even if you are not completely sure what you need, just contact us and we'll try to help. In other words - LET'S TALK.

Where are your servers?

Our servers are hosted on Akamai (formerly Linode) EU data center network in Frankfurt, Germany. You can learn more about security at Akamai's servers by visiting their website here.

Questions about revocation right?

Breakout Point is located in Germany. A Client who is a consumer within the meaning of sec. 13 German Civil Code shall have a revocation right as per this law.

Our subscription services consist of non-physical digital content. In such case, under German law the withdrawal period already starts upon conclusion of the contract. In order to start delivering our digital content before expiry of the withdrawal period, we explicitly ask you on our order overview page via a checkbox:

  • for consent that we begin to execute the contract before expiry of the withdrawal period, and
  • to confirm your knowledge that you will lose revocation right by consenting to the start of the execution of the contract.

Note: Such consent does not affect your right to cancel your subscriptions at anytime to the end of a calendar month.

Instructions on revocation right

You shall be entitled to withdraw from this Contract within fourteen days without giving any reason for doing so. The deadline for withdrawal shall be fourteen days from the date on which the contract has been concluded.

In order to exercise the revocation right, you must notify us (Breakout Point GmbH, c/o Startplatz, Speditionstr. 15a, 40221 Düsseldorf, +49 1567 8550651, info@breakoutpoint.com) of your decision to withdraw from this contract in a clear declaration (e.g. by sending a letter by mail, fax or email). You may use the model withdrawal form attached for this purpose, but, this is not obligatory.

The withdrawal deadline shall be deemed to be met if you send the communication concerning the exercise of the revocation right before the expiry of the deadline.

Effects of withdrawal:

If you withdraw from this contract, we shall refund all payments received from you, including delivery costs (excluding any additional costs incurred if the customer has selected a different type of delivery to the cheapest standard delivery option offered by us), immediately and not later than within fourteen days from the day on which we have received notice of your withdrawal from this contract. We shall use the same payment method for this reimbursement as used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as result of such reimbursement.

Note: According to sec. 356 (5) of the German Civil Code, in the case of a contract for the supply of digital content which is not on a physical data carrier, your right of withdrawal expires if we began to execute the contract after you:

  • have expressly consented that we start to execute the contract prior to expiry of the withdrawal period, and
  • have acknowledged that you will lose the right to withdraw from the contract, by consenting to the start of the execution of the contract.
